Permits the towns of Apex and Cary and the city of Raleigh to enact ordinances allowing sidewalk dining use of state-owned right-of-way in central business districts.

Requires sidewalk dining furniture to be placed at least 6 feet from travel lanes and maintain at least 5 feet of unobstructed pedestrian passage complying with Americans with Disabilities Act requirements.

Restricts sidewalk dining to roadways with maximum posted speed limits of 45 miles per hour or less.

Requires restaurant operators to provide liability insurance naming the Department of Transportation and local government as additional insureds, indemnification agreements, and copies of all relevant state, county, and city permits and licenses.

Allows the Department of Transportation and local governments to refuse permits if sidewalk dining cannot be conducted safely, and permits must be suspended during any street, sidewalk, utility, or public building construction or maintenance.
