Clarifies that planned community declarations, bylaws, and articles of incorporation form the legal basis for the planned community's authority and are enforceable by their terms, provided they are not inconsistent with Chapter 47F.

Amends G.S. 47F-1-104 and G.S. 47F-2-103 to establish that declarations, bylaws, and articles of incorporation provide enforceable authority for planned community actions.

Adds presumption that any amendment to a planned community declaration passed under the statutory procedures or procedures in the declaration is presumed valid and enforceable.

Section 3 becomes effective October 1, 2013, and applies only to amendments recorded on or after that date; remaining sections effective upon enactment.
