Modifies the three-year limitations period for actions based on fraud or mistake under G.S. 1-52(9) to explicitly include constructive fraud.

Creates exceptions to the three-year limitation period where different periods apply to constructive fraud claims under Article 3A of Chapter 39 or actual or constructive fraud claims under G.S. 75-1.1.

Clarifies that the cause of action accrues upon discovery of facts constituting actual or constructive fraud or mistake by the aggrieved party.

Effective upon becoming law and applies only to claims arising after the effective date.
