Excludes persons convicted of a Class A1 misdemeanor from eligibility for conditional discharge on controlled substance offenses.

Modifies G.S. 90-96(a) to add Class A1 misdemeanor convictions (or substantially similar assaultive conduct offenses under federal or state law) to the list of prior convictions that disqualify defendants from conditional discharge.

Applies to persons pleading guilty to or found guilty of misdemeanor drug possession, drug paraphernalia possession, or felony offenses under G.S. 90-95(a)(3).

Becomes effective December 1, 2013, for offenses committed on or after that date.
