Grants the Town of Duck the power of eminent domain for acquiring, constructing, and improving beach erosion control and flood and hurricane protection works.

Authorizes Duck to acquire property required as a source for beach renourishment in connection with erosion control and protection projects.

Allows Duck to exercise eminent domain either independently or in participation with other governmental entities for these coastal protection purposes.

Permits Duck to take immediate possession of condemned property upon filing a complaint and depositing required funds, consistent with procedures available to other coastal municipalities.

Effective upon ratification on July 25, 2014.
