H328 - Highway Safety/Citizens Protection Act

• Increases penalties for possession, manufacture, or sale of false identification documents from Class 1 misdemeanor to Class G felony, with exceptions for underage alcohol/tobacco purchases.

• Creates rebuttable presumption against pretrial release for undocumented aliens charged with sex offenses, violent felonies, driving offenses requiring license revocation, drug offenses, or gang offenses; requires secured appearance bonds for undocumented aliens charged with felonies or Class A1 misdemeanors.

• Prohibits use of matricula consular cards and other foreign consulate documents as acceptable identification for government purposes; removes these documents from driver's license residency requirements.

• Authorizes Division of Motor Vehicles to issue one-year restricted drivers permits and restricted identification cards to undocumented aliens who pass criminal history checks and meet all other licensing requirements.

• Authorizes seizure and impoundment of vehicles driven by persons violating license revocation laws or driving without a valid license or restricted permit, with exceptions if driver produces valid license or proof of financial responsibility.
