H407 Summary: Housing Authority Transfers

• Allows municipalities to transfer public housing authority powers, duties, and responsibilities to a regional council of government, in addition to existing options of transferring to a redevelopment commission or the city itself.

• Permits city councils to abolish housing authorities by resolution with sufficient time to wind down operations, and transfer all property, assets, liabilities, and pending legal actions to the designated entity.

• Authorizes city councils to appoint an interim executive director upon passage of an abolition resolution to facilitate the transfer and serve until complete, with all powers and duties of a regular executive director.

• Enables regional councils of government to acquire real property by purchase, gift, or other means to meet office and program space needs, and to pledge property as security for financing such acquisitions (subject to Local Government Commission approval).

• Regional councils designated to exercise housing authority responsibilities must follow Chapter 157 of the General Statutes for housing matters while continuing to follow existing regional council governance rules; regional councils cannot exercise eminent domain authority.
