Counties may require owners of developed property with residential or commercial establishments to connect to water or sewer lines owned or operated by the county, or alternatively charge a periodic availability charge not to exceed the minimum service charge for connected properties.

Counties may charge a periodic availability charge for improved property that qualifies for a building permit for residential or commercial construction when water or sewer lines are directly available to the property.

The periodic availability charge is capped at the minimum periodic service charge applied to properties that are actually connected to the service.

This act becomes effective upon enactment.
