H567 - Cemetery Minimum Acreage Requirements

• Creates new exemption allowing cemeteries licensed between July 2, 1967, and September 1, 1975, to sell, mortgage, lease, or encumber land that would otherwise be held as minimum acreage, subject to specific conditions.

• Requires the cemetery's county population at licensure did not exceed 45,000 people according to the federal decennial census.

• Mandates another private or public cemetery must be located within a five-mile radius of the cemetery seeking to sell or encumber land.

• Requires the cemetery to maintain at least 15 acres of unencumbered cemetery land for ongoing use.

• Requires the purchaser to transfer 10% of the consideration or value of the interest conveyed (up to 15 acres sold) to the perpetual care fund within 60 days of the sale.
