Session Law 2015-193 (HB 607) Summary

• Authorizes placement of security freezes on credit reports for protected consumers, defined as individuals under age 16, incapacitated persons, or those with appointed guardians.

• Requires consumer reporting agencies to place freezes within 30 days upon receipt of request from a representative with sufficient proof of identification, authority, and a fee (up to $5.00).

• Eliminates fees for freeze placement or removal if: the minor is under 16 with an existing consumer report, the consumer is over 62, or a law enforcement report of identity theft exists.

• Freezes remain in effect until removed by the protected consumer or representative with proper documentation and fee, or until the agency determines the freeze was based on material misrepresentation.

• Specifies 12 exceptions allowing access to frozen credit reports, including existing account holders, law enforcement, government agencies, and certain financial institutions; also exempts certain specialized consumer reporting agencies from freeze requirements.
