Requires device and medical equipment permit holders and applicants to maintain at least one physical location within North Carolina or within 40 miles of the state border.

Requires permit holders to maintain sufficient inventory to respond to orders or requests within the state in a timely manner.

Exempts disposable medical supply mail order companies from the physical location requirement, provided they comply with Federal Trade Commission regulations 16 C.F.R. 435.1 through 435.3 and United States Postal Service requirements.

Excludes from mail order company definition any companies supplying respiratory care, oxygen equipment, or other equipment necessary to prevent immediate threats to consumer health or safety.

Exempts pharmaceutical manufacturers registered with the Food and Drug Administration and their wholly owned subsidiaries from these requirements; effective October 1, 2015.
