Prohibits the manufacture, sale, offer for sale, or distribution of bedding containing organohalogen and organophosphorus flame retardants in North Carolina, effective January 1, 2017.

Exempts used or renovated bedding from the prohibition and allows the Commissioner of Agriculture and Consumer Services to grant exemptions for up to two years if no feasible alternative exists at comparable cost or if alternative poses greater health risk.

Establishes civil penalties ranging from $100-$1,000 per article of bedding on first, second, and subsequent violations respectively, with maximum fines of $5,000, $25,000, and $50,000; knowing violations subject to triple penalties.

Requires manufacturers to provide certificates of compliance within 10 days when requested and prohibits replacement of regulated flame retardants with chemicals of similar toxicity, bioaccumulation, or persistence concerns.

Directs the Department of Agriculture and Consumer Services to develop education programs for retailers, establish optional labeling for flame-retardant-free bedding, and provide annual reports to the Environmental Review Commission on flame retardant use and alternatives.
