H714 - Behavior Analyst Licensure

• Creates the North Carolina Behavior Analysis Board to regulate the practice of behavior analysis through licensure of behavior analysts and assistant behavior analysts, with nine members appointed by the Governor, Speaker, and President Pro Tempore.

• Establishes licensure requirements for behavior analysts and assistant behavior analysts based on certification from the Behavior Analyst Certification Board, including application fees not to exceed $250 and renewal fees not to exceed $200 every two years.

• Prohibits unlicensed persons from practicing behavior analysis or representing themselves as behavior analysts, with violations constituting Class 2 misdemeanors.

• Exempts from licensure requirements licensed psychologists, students in approved programs, family members implementing treatment plans, animal behaviorists, and other licensed professionals providing services within their scope of practice.

• Establishes a behavior analyst-client privilege in civil and criminal proceedings, with exceptions for mandatory reporting of child abuse, neglect, and disabled adult abuse.
