Prohibits electric public utilities from recovering costs from retail customers related to unlawful discharges of coal combustion residuals to surface waters, unless the discharge resulted from force majeure.

Prohibits electric public utilities from recovering costs from retail customers related to management of coal combustion residuals disposed of in surface impoundments, including compliance costs under Part 2I of Article 9 of Chapter 130A of the General Statutes.

Defines "unlawful discharge" as any discharge resulting in a violation of State or federal surface water quality standards.

Effective upon becoming law.
