House Bill 766 Summary

• Increased THC threshold for hemp extract from 0.3% to 0.9% by weight and decreased minimum CBD requirement from 10% to 5% by weight.

• Eliminated requirement for hemp extract registration cards issued by Department of Health and Human Services; instead requires caregivers to register with the Department and possess a neurologist's written statement.

• Expanded eligible neurologists from those affiliated with four specific universities (UNC Chapel Hill, East Carolina, Duke, Wake Forest) to any neurologist affiliated with hospitals licensed in North Carolina.

• Changed the program from a limited pilot study model to general authorization for hemp extract use as alternative treatment for intractable epilepsy without pilot study participation requirements.

• Repealed Article 5G of Chapter 90 effective July 1, 2021, eliminating the entire epilepsy alternative treatment registration system.
