Department of Health and Human Services must allow dependents of armed forces members to maintain Medicaid home- and community-based waiver status when the service member is transferred outside North Carolina, provided the service member maintains North Carolina as legal residence and the dependent meets all Medicaid and waiver eligibility criteria.

Dependents on waiver waiting lists shall maintain their position on the list during the service member's out-of-state assignment.

Dependents who were receiving waiver services before transfer shall be reinstated to their original waiver slot upon returning to North Carolina if the slot remains available, or receive priority placement on the next available waiver slot.

Department must submit any necessary Medicaid State Plan Amendments or waiver amendments to federal authorities to implement these provisions.

Section 1 becomes effective January 1, 2017; remainder of bill effective upon enactment on June 30, 2016.
