Requires a judge (rather than a magistrate or judicial official) to determine pretrial release conditions for defendants charged with domestic violence offenses involving spouses, former spouses, cohabitants, or dating partners.

Expands the definition of domestic violence relationships to include persons in a dating relationship as defined in G.S. 50B-1(b)(6), in addition to spouses and cohabitants.

Mandates that judges consider the defendant's criminal history report when setting conditions of pretrial release in domestic violence cases.

Adds a new aggravating factor for sentencing: when the defendant knew or reasonably should have known that a person under age 18 was witnessing the offense by sight or hearing.

Effective December 1, 2015, for offenses committed on or after that date.
