Authorizes the Governor or General Assembly to grant up to five days of leave annually to state employees affected by declared emergencies.

Leave must be authorized through language included in the executive order or resolution declaring the state of emergency and can include up to two days of uncompensated leave or three days of compensated leave (five days total maximum per employee annually).

Emergency declaration authority may specify procedures for taking leave, types of leave available, and restrictions on which state employees may take leave if necessary to protect critical state functions.

Emergency leave does not accumulate toward an employee's leave balance, is not counted against accumulated earned leave, and does not count toward creditable service for retirement purposes.

Provisions become effective when the act becomes law.
