S423 - Foster Care Family Act

• Establishes a "reasonable and prudent parent standard" allowing foster parents and child care institution officials to approve foster children's participation in extracurricular, enrichment, cultural, and social activities without court approval, including overnight activities up to 72 hours.

• Provides liability protection for foster parents and designated officials acting under the reasonable and prudent parent standard, except in cases of gross negligence, willful and wanton conduct, intentional wrongdoing, or motor vehicle operation.

• Requires the Rate Bureau to develop optional personal liability insurance policy forms for licensed foster parents by May 1, 2016.

• Allows foster youth age 16 and older in state custody to contract for automobile insurance with court consent and permits foster parents to maintain liability insurance with named driver exclusions for foster children who carry their own insurance.

• Directs the Department of Health and Human Services to design a 1915(c) Medicaid waiver for children with serious emotional disturbance and report findings to the Joint Legislative Oversight Committee on Health and Human Services by December 1, 2015.
