Establishes a moratorium on executing any person sentenced to death in North Carolina courts until specific conditions are met.

Moratorium ends only when the State implements policies ensuring fair and impartial administration of death penalty cases in accordance with due process.

Required policies must establish guidelines for appointment and performance of competent counsel in capital cases.

Required policies must preserve and enhance State court authority to exercise independent judgment on constitutional claims in postconviction and habeas corpus proceedings.

Required policies must eliminate discrimination in capital sentencing based on the race of the victim or defendant.
