Director of the Division of Water Resources is prohibited from requiring on-site stormwater control measures to protect downstream water quality standards, except as required by State or federal law.

Environmental Management Commission must adopt permanent rules amending 15A NCAC 02H .0506 to be consistent with the prohibition on requiring on-site stormwater control measures.

The permanent rules adopted by the Commission must be substantively identical to Section 2 of the act and are exempt from standard rulemaking procedures under Chapter 150B of the General Statutes.

Section 2 of the act (the interim prohibition) expires when the Environmental Management Commission's permanent rules become effective.

The act becomes effective upon enactment.
