Senate Bill 778 Summary

• Allows counties to require performance guarantees for new subdivision streets outside municipal jurisdiction, but permits developers to proceed without a guarantee if they provide a residual performance guarantee before building permits are issued.

• Caps performance guarantee amounts at 125% of reasonably estimated completion costs and limits residual performance guarantees (for pavement repairs only) to the greater of 15% of total construction costs or 125% of travel surface costs.

• Requires the Division of Highways to accept fully constructed streets meeting specified conditions (including 6+ years of public use, proper pavement and drainage, and occupied homes) within 60 days of a county proposal, effective January 1, 2017.

• Mandates counties establish a public street database by January 1, 2018, showing road status as federally-maintained, state-maintained, city-maintained, privately-maintained, or pending public acceptance.

• Requires the Department of Transportation to reimburse schools for street improvements needed for safe ingress/egress to highways and municipal streets, and prohibits cities from requiring school-related street improvements beyond those physically connected to school driveways.
