S868 Summary - Local Government Immigration Compliance

• Recodifies G.S. 15A-311 as G.S. 64-6 and repeals an exception allowing law enforcement to use identity documents when no other identification is available.

• Prohibits use of matricula consular documents and other non-passport consulate documents, as well as locally-issued identity documents, by government officials in determining identity or residency.

• Creates a complaint and investigation process allowing any person to file statements with the Attorney General alleging local government or law enforcement noncompliance with immigration-related state laws, with investigations to be completed within 60 days.

• Imposes financial penalties on noncompliant municipalities and counties by withholding state education and transportation funding distributions for at least one fiscal year, with extended penalties if noncompliance is not remedied within 60 days.

• Appropriates $20,000 to the Department of Justice for fiscal year 2016-2017 to develop and maintain a public complaint form and database of noncompliant local governments; effective August 1, 2016.
