Proposes a constitutional amendment to replace the elected Superintendent of Public Instruction and State Board of Education with an appointed Secretary of Education heading a Department of Education within the Executive Branch.

The Secretary of Education would be appointed by the Governor and confirmed by joint resolution of the General Assembly, with procedures established by law for filling temporary vacancies.

Removes the Superintendent of Public Instruction from the list of statewide elected officers in Article III, Section 7(1) of the North Carolina Constitution.

Amendment would be submitted to voters at the 2016 North Carolina presidential preference primary election with approval requiring a majority of votes cast on the question.

If approved by voters, the amendment becomes effective January 1, 2017; extends terms of State Board of Education members beyond their normal expiration dates until that date; and eliminates the 2016 general election for Superintendent of Public Instruction.
