H1008 - Replacement ROW for Utility Relocation

• Authorizes the Department of Transportation to acquire replacement right-of-way when utilities must be relocated from a Department-owned right-of-way where the utility owner contributed to original acquisition costs.

• Permits the Department to assign easement rights of the replacement right-of-way to the utility owner with their agreement, as an alternative to reimbursing relocation costs.

• Amends G.S. 136-19.5(c) to add this replacement right-of-way option to existing utility relocation provisions.

• Applies to all utilities including cable service operators as defined in G.S. 105-164.3.

• Becomes effective upon enactment.
