H1070 - Safer Schools, Healthier Kids Act

• Establishes Extreme Risk Protection Orders (ERPOs) allowing family members or law enforcement to petition courts to temporarily restrict firearm access for individuals posing danger to themselves or others, with clear and convincing evidence required for ex parte orders and preponderance of evidence for full orders lasting up to one year.

• Requires permits for purchase of assault weapons and long guns (in addition to existing pistol permits), with assault weapons defined as specific semiautomatic firearms and those meeting certain criteria like detachable magazines, folding stocks, or flash suppressors.

• Prohibits sale of assault weapons to persons under 21 and long guns to persons under 18; increases penalties for selling these weapons to minors to Class H felony; makes possession of these weapons by minors a Class 1 misdemeanor with limited exceptions.

• Bans manufacture, sale, and possession of bump stocks, trigger cranks, and similar devices designed to increase firearm rate of fire, classified as Class I felony.

• Appropriates $65.7 million for school safety including $25 million for facility improvements, $40 million for instructional support personnel (nurses, counselors, psychologists, social workers), $7 million for school resource officers in high schools, and $1.67 million for anonymous safety tip line expansion.
