HB 13 - Class Size Requirement Changes

• Phase in class size requirements over two school years: 2017-2018 school year allows average class size of 20 students K-3rd grade with individual classes capped at 23 students after the second month; full requirements take effect in 2018-2019 school year.

• Establish specific funded class size allotment ratios for K-3rd grade: kindergarten 1 teacher per 18 students, first grade 1 per 16 students, second and third grades 1 per 17 students.

• Require biannual reporting in September and February to the Superintendent of Public Instruction detailing class organization, teacher duties, funding sources, student enrollment including exceptions, and program enhancement teachers at each school.

• Authorize State Board to grant waivers from class size requirements only under specific circumstances: emergencies, unexpected enrollment increases over 2%, organizational problems in isolated districts, subject-specific classes, or charter school closures.

• Require local superintendents to submit sworn affidavits with biannual reports certifying compliance; impose penalty of withheld state salary funds for willful superintendent noncompliance with class size requirements.
