Repeals G.S. 14-50.16 and creates standardized definitions for "criminal gang," "criminal gang activity," "criminal gang member," and "criminal gang leader or organizer" in new G.S. 14-50.16A, replacing previous "street gang" terminology with "criminal gang" throughout statutes.

Establishes sentencing enhancement in G.S. 15A-1340.16E for felonies committed as part of criminal gang activity: one class level higher for regular members, two class levels higher for criminal gang leaders or organizers (capped at Class C felony).

Increases penalties for gang-related offenses: Class H felony to Class G for threatening to deter gang withdrawal (G.S. 14-50.19); Class F felony for physically injuring someone to deter gang withdrawal; Class G to Class F felony for retaliation against gang members who withdraw (G.S. 14-50.20).

Increases penalty for soliciting minors under 16 to participate in gang activity from Class F to Class H felony for persons 16 and older (G.S. 14-50.17 and 14-50.18).

Extends duration of nuisance abatement orders from one year to three years after entry (G.S. 14-50.43) and clarifies innocent owner defenses for property used in gang activity; effective December 1, 2017.
