Creates new felony offense of "felonious assault as a hate crime" for assaults inflicting serious bodily injury motivated by actual or perceived race, color, religion, nationality, country of origin, gender, sexual orientation, gender identity, or disability, classified as Class F felony (Class E if death results or sexual offenses/kidnapping involved).

Expands misdemeanor hate crime protections under G.S. 14-3 to include gender, sexual orientation, gender identity, and disability in addition to existing race, color, religion, nationality, and country of origin protections.

Renames and updates G.S. 14-401.14 from "ethnic intimidation" to "intimidation by hate crime" and expands protected categories to include gender, sexual orientation, gender identity, and disability for assault, property damage, threats, and unlawful assembly violations.

Amends sentencing aggravating factor in G.S. 15A-1340.16(d)(17) to include actual or perceived gender, sexual orientation, gender identity, and disability as factors that can increase penalties.

Becomes effective December 1, 2017, for offenses committed on or after that date.
