H185 - North Carolina Medical Cannabis Act

• Establishes a regulated medical cannabis system allowing qualified patients with debilitating medical conditions to legally possess, cultivate, and use cannabis with a physician's written certification.

• Creates registry identification cards issued by the Department of Health and Human Services for qualified patients and designated caregivers, valid for two years and requiring a $10 fee for changes or replacements.

• Licenses medical cannabis centers, cannabis producers, and cannabis-infused product producers through the Department of Agriculture and Consumer Services, with $5,000 initial license fees and 10-15% monthly gross revenue fees depending on business type.

• Protects qualified patients, caregivers, physicians, and licensed producers from arrest, prosecution, and civil penalties for medical cannabis activities; exempts medical cannabis metabolites from employment and housing discrimination.

• Establishes affirmative defenses to cannabis possession charges and requires UNC to create a cannabis research program to study efficacy and safety; becomes effective only upon voter approval of a constitutional amendment.
