H310 - Wireless Communications Infrastructure Siting

• Authorizes cities to regulate collocation of small wireless facilities in public rights-of-way through administrative permits with streamlined approval timelines (45 days from complete application or deemed approved).

• Prohibits cities from imposing moratoria on small wireless facility applications and limits application fees to $100 per facility for the first five facilities plus $50 each thereafter, with technical consulting fees capped at $500.

• Establishes maximum rates of $50 per year for wireless provider access to city utility poles and requires cities to process make-ready work estimates within 60 days and complete work within 60 days of acceptance.

• Defines small wireless facilities as equipment with antennas in enclosures no larger than 6 cubic feet and associated equipment under 28 cubic feet, with height limits of 10 feet above existing poles in city rights-of-way and 50 feet for new poles.

• Grants the Department of Transportation authority to issue permits for wireless facilities along state-maintained highways under similar nondiscriminatory standards.
