H466 - Pharmacy Patient Fair Practices Act

• Adds definitions for "insured," "pharmacist," and clarifies existing definitions related to pharmacy benefits managers (PBMs) in North Carolina insurance law.

• Prohibits PBMs from penalizing pharmacies or pharmacists for discussing patient cost-sharing information or recommending lower-priced drugs to patients.

• Prevents PBMs from restricting pharmacies' ability to offer direct and limited delivery services as an ancillary service.

• Prohibits PBMs from charging patients co-payments exceeding the total submitted charges by the network pharmacy.

• Requires PBM-insurer contracts to be available for Department of Insurance review and mandates reporting of violations to the Attorney General; excludes employee benefit plans under ERISA and Medicare Part D from certain requirements.

• Effective date: October 1, 2017, applying to all contracts entered into, renewed, or amended on or after that date.
