HB 576 Summary

• Department of Environmental Quality must approve aerosolization of leachate and wastewater from lined sanitary landfills for municipal solid waste disposal, except for facilities permitted for coal combustion residuals or swine lagoon wastewater.

• Department may approve aerosolization of leachate from unlined landfills at its discretion.

• Aerosolization resulting in zero-liquid discharge that is not a significant air contamination source does not require a permit under Article 21 or Article 21B of Chapter 143 of the General Statutes.

• Applicants must provide data characterizing contaminants of concern around landfills emanating from aerosolization.

• Department of Environmental Quality must report findings and recommendations on aerosolization projects to the Environmental Review Commission by March 31, 2018.
