House Bill 619 Summary

• Prohibits manufacturers from requiring dealers to relocate or substantially alter facilities if the dealer invested over $250,000 (indexed to Consumer Price Index) in facility improvements within the preceding 10 years as part of a manufacturer-sponsored initiative.

• Expands manufacturer warranty and recall obligations to include compensation for used motor vehicles subject to recall at a prorated rate of at least 1.5% monthly of average trade-in value, with claims processed within specified timeframes.

• Requires manufacturers to provide dealers with annual lists of all third parties who have received dealer customer data from dealer management computer systems, with dealers able to revoke consent upon five business days written notice.

• Prohibits manufacturers from using unfair, unreasonable, arbitrary, or inequitable sales and service performance criteria to cancel or terminate dealer franchises, requiring consideration of comparable local and regional market data.

• Extends the effective date for requiring dealers to display "LD" license plates on service loaner vehicles from January 1, 2019 to January 1, 2021.
