H63 - Citizens Protection Act of 2017

• Increases penalties for manufacturing or selling false identification documents from Class 1 misdemeanor to Class G felony, while possession or obtaining false identification remains a Class 1 misdemeanor.

• Creates a rebuttable presumption against pretrial release for undocumented aliens charged with sex offenses, violent felonies, driving offenses, drug offenses, gang offenses, or those with pending ICE detainers; requires secured appearance bonds for undocumented aliens charged with felonies or Class A1 misdemeanors.

• Establishes procedures for verifying immigration status through federal methods, makes immigration status records admissible in court, and authorizes law enforcement to transport unlawfully present aliens to federal facilities or transfer points.

• Creates enforcement mechanism allowing Attorney General to investigate local government noncompliance with immigration-related laws upon complaint, with non-compliant jurisdictions losing eligibility for specified state tax distribution funds for up to two years.

• Effective dates: Sections 2 and 3 effective December 1, 2017 for offenses committed after that date; Section 5 effective August 1, 2017; remainder effective upon enactment.
