Fire departments may apply to the Department of Insurance for a waiver from the requirement to maintain 20 primary personnel for certification inspection purposes.

A waiver may be granted upon showing that the waiver is justified by the volume of calls received and would not cause significant deterioration in the fire department's response capability.

Any waiver granted cannot reduce the primary personnel requirement below 15.

The Department of Insurance must adopt permanent rules consistent with the waiver provisions, which are exempt from standard rulemaking procedures under North Carolina law.

The temporary provisions expire when the Department's permanent rules become effective.
