H723 - Gun Safety Act Summary

• Repeals "stand your ground" laws and codifies common law self-defense rights limited to home defense against intruders when occupant reasonably apprehends death, serious bodily harm, or felony intent.

• Requires firearm owners to carry liability insurance of at least $100,000 before owning or transferring firearms, with exemptions for law enforcement officers; existing owners must obtain insurance by January 15, 2018.

• Prohibits large-capacity magazines (over 15 rounds for rifles, over 8 for shotguns) with criminal penalties; grandfathers magazines owned before December 1, 2017, and exempts manufacturers and government agencies.

• Establishes gun violence restraining order process allowing immediate family members and law enforcement to petition courts to temporarily or permanently prohibit individuals from possessing firearms when they pose significant danger to themselves or others.

• Requires reporting of lost or stolen firearms within 48 hours, mandates sheriff notification to national background check system when denying permits, strengthens firearm safe storage laws for minors and unauthorized persons, and directs state pension fund divestment from firearms manufacturers.
