H767 - NC Toxic-Free Kids Act

• Prohibits retailers and wholesalers from selling children's products containing Bisphenol A (BPA), Phthalates (above 0.10% by weight), or TRIS flame retardants (above 50 parts per million) effective July 1, 2019.

• Requires retailers and distributors to provide annual notice to the Department of Environment and Natural Resources by October 1, 2018, listing any children's products containing these regulated chemicals, including product descriptions, chemical amounts, and manufacturer information.

• Exempts previously owned products, nonprofit sales, casual sales, medical devices, pharmaceuticals, food packaging (except infant food/formula containers), motor vehicles, consumer electronics, and outdoor sport equipment from the prohibitions.

• Directs the Department of Environmental Quality to report to the General Assembly by January 1, 2019, evaluating chemical use data and recommending legislation to protect children's health and improve alternatives assessment processes.

• Applies enforcement authority to the Secretary of Environment and Natural Resources and local health directors under existing enforcement provisions in Chapter 130A.
