Requires mutual agreement between adjoining property owners to establish bona fide ownership before cutting or removing timber, shrubs, or trees.

Places the burden on the party seeking to cut timber to pay for a boundary line survey if owners dispute the property line or fail to reach mutual agreement.

Presumes that anyone cutting timber without prospectively establishing bona fide ownership acted willfully and with knowledge, making them liable for double the value of timber removed under G.S. 1-539.1(a).

Maintains existing liability for double damages for unlawful timber cutting, burning, or removal without owner consent, and extends liability to those with misrepresented property lines under contract.

Effective January 1, 2018.
