H805 - Disclosure of Cosmetics Ingredients

• Requires cosmetics manufacturers to disclose the full list of ingredients, including component ingredients of fragrances, flavors, and color additives on their websites.

• Mandates inclusion of Chemical Abstract Service Registry Number (CAS RN) for each ingredient listed on manufacturer websites.

• Requires ingredients to be listed in descending order of predominance on websites, except ingredients present at 1% or less concentration may be listed in any order.

• Makes violations subject to civil penalties under G.S. 160-124.1, but exempts this violation from being classified as misbranding under Article 12 of Chapter 106.

• Becomes effective July 1, 2018, with the Board of Health and Human Services required to adopt permanent rules consistent with the new disclosure requirements.
