Legislation takes effect only if North Carolina voters approve a constitutional amendment protecting the right to work in November 2018.

Declares that the right to work must be protected free from undue restraints and coercion, and that no person's employment rights can be denied based on labor organization membership or non-membership.

Prohibits agreements between employers and labor organizations that deny employment to non-members, condition employment on union membership, or grant unions an employment monopoly.

Prohibits employers from requiring employees to become or remain members of a labor organization, abstain from membership, or pay union dues, fees, or charges as a condition of employment.

Provides private right of action for persons denied employment in violation of these protections to recover damages from employers and other parties acting with them.
