Exempts continuing care retirement communities licensed under North Carolina law from obtaining a certificate of need to establish a home health agency that serves only their residents under continuing care contracts.

Home health services provided by continuing care retirement communities must be limited to residents who have contracted with the community to receive continuing care services with lodging.

Continuing care retirement communities that wish to provide home health services to individuals outside their resident population must still obtain a certificate of need as a home health agency.

Exemption applies only to certificate of need review; continuing care retirement communities must still comply with all state home health agency licensure and certification requirements.

Effective upon enactment and applies to continuing care retirement communities providing home health services on or after the law takes effect.
