H976 - Extreme Risk Protection Orders

• Establishes Chapter 50E authorizing courts to issue Extreme Risk Protection Orders (ERPOs) to temporarily restrict firearm access for individuals posing danger to themselves or others.

• Allows family/household members and law enforcement to petition district courts for ERPOs, with ex parte orders issued within 24 hours if imminent danger is shown by clear and convincing evidence.

• Requires respondents to surrender all firearms, ammunition, and firearm permits to the sheriff immediately upon service; sheriffs may charge storage fees and must document all surrendered items.

• Sets ex parte ERPO duration at maximum 10 days and full ERPO duration at maximum one year, with renewal possible if no material change in circumstances is found.

• Modifies the Address Confidentiality Program (Chapter 15C) to include ERPO petitioners alongside domestic violence and stalking victims who fear for their safety.
