NC S109

Creates new felony offense of "felonious hate crime against emergency worker" for assaulting, attempting to assault, or threatening to assault emergency workers (law enforcement officers, firefighters, emergency medical technicians, or medical responders) because of their status

Establishes Class H felony as base punishment, escalating to Class F felony if serious bodily injury is inflicted and Class E felony if a firearm is used in the assault

Increases punishment by one felony class if the offender lures the emergency worker to a location by falsely reporting that emergency services are needed, with intent to harm them because they are an emergency worker

Applies only when conduct is not covered under another provision of law providing greater punishment

Becomes effective December 1, 2017, for offenses committed on or after that date
