Proposes a constitutional amendment to Article I of the North Carolina Constitution by adding a new Section 38 on eminent domain.

Prohibits condemnation of private property by eminent domain except for a public use and requires just compensation to be paid.

Guarantees the right to trial by jury to determine just compensation in all condemnation cases at the request of any party.

Amendment was to be submitted to North Carolina voters at the statewide election on November 6, 2018.

Amendment becomes effective upon certification by the State Board of Elections and Secretary of State and applies to takings after certification.
