Department of Health and Human Services must request a waiver from the USDA by October 1, 2018, to prohibit SNAP benefits for foods with little or no nutritional value, including soft drinks, candy, cakes, and cookies that are subject to state sales tax.

Department must also seek waiver authority to prohibit SNAP use for bulk purchases of grocery items that would be considered prepared food if purchased in smaller quantities.

Within 60 days of USDA granting the waiver, the Division of Social Services shall amend its rules to implement the prohibitions on these food purchases.

Division must report to the Joint Legislative Oversight Committee on Health and Human Services within 30 days of receiving the USDA's decision to grant or deny the waiver request.

The act becomes effective when signed into law.
