Director of the Administrative Office of the Courts, in consultation with the Chief Justice of the Supreme Court, shall submit a report to the Speaker of the House and President Pro Tempore recommending whether and how to establish an arbitration program within the North Carolina Business Court.

Report shall include recommendations on how parties may elect to participate in the arbitration program, required qualifications and training for arbitrators, and requirements for persons representing parties in arbitration proceedings.

Report may include recommendations on appeal procedures for both binding and nonbinding arbitrations conducted under the proposed program.

Director or the North Carolina Dispute Resolution Commission may also include recommendations for establishing a mediation program operated by the Business Court, including party participation procedures, mediator qualifications, and representation requirements.

Bill became effective upon enactment on July 18, 2017.
