Requires permit applicants to first attempt to satisfy compensatory mitigation requirements through private compensatory mitigation banks approved by the U.S. Army Corps of Engineers, with Department approval.

Permits applicants may use alternative mitigation methods (fees into Ecosystem Restoration Fund or permittee-responsible mitigation) only if using a private bank is determined not practicable.

Establishes that all compensatory mitigation banks operating in the state must register with the Division of Mitigation Services and provide bank name, credit types, contact information, property boundaries, and service areas.

Requires the Division of Mitigation Services to cease accepting in-lieu fees for stream, wetland, riparian buffer, and nutrient impacts in the Neuse and Cape Fear River Basins within 36 months of enactment.

Allows the Department to expand the fee cessation program to additional river basins after June 30, 2020, with 24 months public notice, but permits exemptions for Commerce and Transportation Department projects in emergency circumstances.
