S734 Summary: Extreme Risk Protection Orders

• Authorizes district courts to issue Extreme Risk Protection Orders (ERPOs) to temporarily restrict firearm access for individuals posing danger of physical harm to self or others.

• Allows family or household members and law enforcement to petition for ERPOs; ex parte orders can be issued within one day if clear and convincing evidence of imminent danger exists.

• Requires respondents to surrender all firearms, ammunition, and concealed carry permits to the sheriff; orders last up to one year and are renewable based on preponderance of evidence standard.

• Establishes violation of ERPO as Class A1 misdemeanor; includes procedures for firearm storage, retrieval by respondents or third-party owners, and disposal if unclaimed.

• Appropriates $20,000 for training judges, magistrates, court clerks, and law enforcement on ERPO implementation; effective December 1, 2018.
