H1162 Living Donor Protection Act Summary

• Prohibits insurers from denying coverage, limiting benefits, charging higher premiums, or discriminating against living organ donors (including bone marrow donors) based solely on donor status in health, life, accident, disability, and long-term care insurance policies, effective 30 days after enactment.

• Provides a state income tax credit equal to the lesser of $5,000 or unreimbursed live organ donation expenses (including travel, lodging, and lost wages) for taxpayers who donate organs or dependent family members who donate, effective for taxable years beginning January 1, 2020.

• Allows permanent full-time state employees up to 30 days paid leave for organ donation and 7 days paid leave for bone marrow donation, with prorated amounts for part-time employees, after 12 months of continuous employment.

• Extends paid leave provisions to all state employees, public school employees, and community college employees, with annual reporting on the program required beginning April 1, 2021.

• Paid donation leave is separate from sick and vacation leave, cannot be used for retirement purposes, and has no cash value upon employment termination.
